General terms and conditions
By browsing and using the website of Boutique Villa Gyula, as well as by making a reservation, you accept that you have read and understood the following terms and conditions (including the privacy statement, policy and reservation and cancellation rules) and that you agree with their contents.
General provisions
1. ) The Operator of the Boutique Villa Gyula: Anna Teréz Kovács (1097 Budapest, Nádasdy utca 10. 9/902a) - hereinafter referred to as the Accommodation Provider - enters a contract based on these general terms and conditions to provide accommodation services.
2.) The general contractual conditions do not preclude the Accommodation Provider from entering into contract with tour operators, organisers, legal entity clients, individual entrepreneurs, either on the basis of these general contractual conditions or on terms that differ in part or in whole from these general conditions.
Contracting parties
1.) The service of the Accommodation Provider is always used by the Guest.
2.) If the Guest orders the Accommodation Provider's services directly from the Accommodation Provider, the accommodation provider contract is established between the Guest and the Accommodation Provider.
3.) If the services are ordered by a third party (intermediary) on the basis of the Guest's order, the contract is established between the Accommodation Provider and the intermediary, and the conditions for the provision of other accommodation services by the Accommodation Provider are regulated by this contract. The Accommodation Provider is not obliged to investigate whether the third person legally represents the Guest, therefore the Accommodation Provider does not assume responsibility.
4.) The Accommodation Provider only enters into a contract with a person capable of acting.
5.) Incapacitated persons or persons under the age of 18 may only use the services of the Accommodation Provider with an adult accompanying them.
Creation of the contract
1.) The Accommodation Provider accepts reservations through its online reservation system and by e-mail.
2.) The Accommodation Provider sends a written offer to the Guest's written offer request. The accommodation provider's offer will cease to be binding if a declaration (order) regarding the acceptance of the offer with unchanged content is not received within 48 hours of the offer being sent, or a 30% advance payment of the accommodation fee is not received.
3.) The contract is concluded with written confirmation from the Accommodation Provider. The contract enters into force on the day the confirmation is sent.
4.) The contract is considered a written contract, the request for quotation, the offer, the order and the confirmation are part of the contract.
5.) The contract must contain the following information about the Guest/Contracting Party and the reservation:
• Guest/Contracting party name,
• Place of birth,
• Date of Birth,
• address (seat),
• phone number,
• e-mail address,
• date of arrival and departure
• number of nights
• number of arriving guests (adults, children under 18 broken down)
• room name
6.) The Villa can be booked for a specified minimum night depending on the individual seasons. Current information about this can always be found on the website.
7.) Verbal orders/reservations, modifications, agreements, and verbal confirmations from the Accommodation Provider are not contractual.
8.) The Accommodation Provider is entitled to stipulate different terms and conditions in its offer than these general terms and conditions.
9.) If the Guest permanently leaves the Villa before the end of the period specified in the contract, the Accommodation Provider is entitled to the full amount of consideration for the service specified in the contract.
10.) The Accommodation Provider is entitled to resell a room vacated before the expiry date.
11.) The prior written consent of the Accommodation Provider is required for the extension of the accommodation service initiated orally or in writing by the Guest. In this case, the Accommodation Provider may demand full consideration for the services already provided, and may make the extension subject to the fulfillment of this condition.
12.) The contract may be amended or supplemented by the Guest and the Accommodation Provider together in writing.
Withdrawal from the contract
1.) If the Accommodation Provider has not specified any other condition in its offer, the Guest may withdraw from the contract without penalty by making a written statement up to the 8th day before the date of arrival specified in the contract. In case of cancellation within this period, a penalty specified in the cancellation conditions stated in the confirmation sent by the Villa is obliged to pay.
2.) From the 7th day before the planned arrival, the penalty rate is 100%.
3.) If the contracting party has not ensured the use of the accommodation service by paying the accommodation fee in full or by paying in advance within 2 working days after the date of the reservation, the Accommodation Provider has the right to withdraw from the contract and release the accommodation included in the contract.
Prices
1.) The current prices of the Accommodation Provider are posted on the website www.boutiquevillagyula.hu.
2.) Prices may differ on websites that mediate Accommodation Provider's products (for example: Szállás.hu, booking.com). The price booked on the given page is always the authoritative one, which, in the case of Euros, is calculated using the Hungarian National Bank exchange rate valid on the day of the reservation.
3.) The Accommodation Provider is free to change its advertised prices without prior notification.
4.) When announcing the prices, the Accommodation Tax shall indicate the amount of tax charged on the service, defined by law, valid at the time of the offer. The Accommodation Tax will transfer the additional charges due to changes in tax legislation to the contracting party with prior notice.
5.) The Accommodation Provider publishes the current promotions and discounts on its website. The advertised discounts cannot be combined with any other discounts.
6.) Discounts and promotions published after the Accommodation Provider's offer has been sent do not affect the sent offer.
Payment method, booking guarantees
1.) The Accommodation Provider requests advance payment (deposit) for the services provided to the Guest no later than the 2nd working day after the reservation. The deposit is 30% of the total price of the accommodation, which must be paid by the 2nd working day after the reservation. Payment of the remaining part of the accommodation fee is due no later than the day of arrival.
2.) The Accommodation Provider will issue the invoice in HUF.
3.) The Guest can pay the accommodation fee or the advance payment by bank transfer.
4.) In the case of bank transfer - unless the agreement concluded with the Accommodation Provider stipulates otherwise - the Guest must transfer the value of the ordered services to the Accommodation Provider's bank account before the specified date of arrival.
5.) The cost incurred in connection with the use of the payment method shall be covered by the Guest.
Conditions for using the accommodation:
1.) The Guest can book the apartment from 2 p.m. on the day of arrival. If the Accommodation Provider is not staying at the accommodation, the keys can be taken from the key safe. Accommodation Provider will send the code of the safe to the Guest by e-mail no later than the day before arrival.
2.) The Guest must leave the Villa with his luggage and personal belongings by 10 a.m. on the last day of stay according to the contract.
3.) If the Guest wants to occupy or leave the room before and/or after the time specified above, a separate agreement with the Accommodation Provider is required, for which the Accommodation Provider may charge an additional fee.
4.) We cannot accept pets.
5.) Smoking is prohibited in the rooms of the Villa!
Refusal to fulfill the contract, termination of the service obligation
1.) The Accommodation Provider is entitled to terminate the contract for accommodation services with immediate effect, thus refusing to provide the services, if:
a) the Guest does not use the provided apartment or the facility as intended,
b) the Guest does not comply with the security regulations and rules of the Accommodation Provider, behaves objectionably or rudely, is under the influence of alcohol or drugs, exhibits threatening, offensive or other unacceptable behavior,
c) the Guest suffers from an infectious disease,
d) the Guest does not fulfill the payment and advance payment obligations specified in the contract by the specified date
2.) The contract between the parties is terminated if its fulfillment becomes impossible due to force majeure.
Rights and obligations of the Guest
1.) The Guest is entitled to the intended use of the apartment and the facilities of the accommodation, which are part of the standard range of services, and which the parties have agreed upon in the contract, and are not subject to special conditions.
2.) The Guest may make a complaint regarding the performance of the services provided by the Accommodation Provider during the stay at the accommodation. The Accommodation Provider examines and handles complaints submitted to it in writing during this period.
3.) After leaving the Villa, the Guest's right to complain ceases.
4.) The Guest is obliged to settle the consideration for the services ordered in the contract by the time and in the manner specified in the contract.
5.) The Guest ensures that persons under 18 years of age will stay in the Villa under permanent parental supervision.
6). The Guest ensures that persons under 18 years of age in the Villa will not consume alcoholic beverages.
7.) The Guest uses the Accommodation Provider's equipment, tools and services as intended.
8). The guest is responsible for all damages and disadvantages caused by the guest, his or her companion or a person under their supervision to the Accommodation Provider or a third party.
9.) This responsibility of the Guest exists even if the harmed party is entitled to claim compensation for the damage directly from the Accommodation Provider. The Accommodation Provider must notify the Guest in writing of the damage, no later than 2 days after departure. The Accommodation Provider takes a photo of the damage caused and sends it to the Guest. If the extent of the damage exceeds HUF 10,000, the Guest must pay the amount of the damage to the Accommodation Provider within 5 working days.
Rights and obligations of the Accommodation Provider
1.) Based on the contract, the Accommodation Provider is obliged to provide the ordered accommodation and other services in accordance with the relevant regulations and standards.
2.) The Accommodation Provider is obliged to investigate the written complaint of the Guest and to take the necessary steps and measures to remedy the complaint.
3.) The Accommodation Provider provides information about the Guest's stay in the Villa to third parties, including the Guest's close relatives, only based on the Guest's prior written permission. This prohibition of information does not apply to inquiries based on the law.
4.) The Accommodation Provider is not responsible for the Villa's equipment, facilities, etc. for damages resulting from improper use.
5.) The Accommodation Provider is not responsible for personal items left in the Villa's communal areas or apartments.
6) The host is not responsible for any damage, disadvantage or harm caused to the guest and/or the person under his/her supervision by another guest of the Villa.
Dispute resolution
The parties to the contract will primarily settle disputes arising in connection with the performance of the contract amicably. If the peaceful way is unsuccessful, the legal relationship between the contracting parties is governed by the provisions of the Hungarian Civil Code. Any legal dispute arising from the service contract shall be settled by the court having jurisdiction at the place of service.
